Applicability
1.1. By accessing or using this Site, including its software tools, applications, or any other services provided by SFNM INK, (the legal entity known as New Mexican Inc.)(“New Mexican Inc,” “we,” “us,” or “our”) you agree to comply with our Privacy and Cookie Policy, the Product-Specific Terms, and these General Terms and Conditions (collectively referred to as the “New Mexican Inc. Terms”). Additionally, you agree to adhere to any other terms, policies, guidelines, or rules that may be posted in connection with specific sections or services of this Site (the “Additional Terms”). All Additional Terms are incorporated into the agreement between you and New Mexican Inc. upon accessing or using the relevant sections, services, or features, or agreeing to their application. These New Mexican Inc. Terms, along with any Additional Terms you have accepted, constitute the complete agreement between us and supersede all prior agreements or understandings.

1.2. If you are using this Site on behalf of any business, organization, or other entity, you confirm that you have the authority to accept these New Mexican Inc Terms on its behalf and to bind that entity to them.
1.3. All offers, promotions, transactions, orders, and agreements related to New Mexican Inc. products or services on our Site governed by these New Mexican Inc. Terms.
1.4. Any terms or conditions from the customer or any third party are explicitly excluded and will not apply, even if New Mexican Inc. has not specifically rejected them.
1.5. New Mexican Inc. reserves the right to modify this Site and these New Mexican Inc. Terms at any time, without prior notice. You should review these terms each time you access the Site.
Your Account
2.1. Please refer to the “Member Account” section in the New Mexican Inc. Account Terms.
2.2. You are responsible for all activities conducted using your New Mexican Inc. account. You agree to protect your login credentials (such as your password) and control access to your account, particularly if you grant others in your business or household access. You will be responsible for any orders or actions taken through your account.
Terms of Sale
3.1. For all customers: All our offers and promotions are non-binding and subject to availability and order confirmation. New Mexican Inc. reserves the right to refuse any order without needing to provide an explanation. A contract between you and New Mexican Inc. is formed when you receive an order confirmation email for retail sales as well as when you send a signed quote form back to the New Mexican Inc. for commercial sales. New Mexican Inc. has the right to refuse any content, order, or suspend or terminate services at its discretion, particularly in cases of violation of these Terms.
3.2 For commercial customers: Compensation: In the event that this Contract is terminated by the Client prior to completion of the Services but where Services have been partially performed, The New Mexican Inc. will be entitled to pro rata payment of the Compensation to the date of termination provided that there has been no breach of contract on the part of The New Mexican Inc.
3.4 For commercial customers: Reimbursement of Expenses: The New Mexican Inc. will be reimbursed for reasonable and necessary expenses incurred by The New Mexican Inc. in connection with providing services, which would include purchasing of addresses/zip codes, special paper materials, and etc.
For commercial customers (3.5-3.9 apply):
3.5 Prices are valid for thirty (30) days from the date of this quotation. Signing and returning quotation or the submission of your Print Order and files within those thirty (30) days will secure the pricing for up to sixty (60) days from the date of this quotation. Any job received after sixty (60) days from the quote date will be subject to a new pricing quote.
3.6 Quotation does not include sales tax. New Mexican Inc. is obligated to collect sales tax for any non-exempt jobs for the State of New Mexico. Sales Tax is assessed based upon the point of exchange of the final product.
3.7 Delivery prices are quoted as per delivery location specified. If no delivery location is specified, prices based on pick up at the New Mexican Inc. dock at 1 New Mexican Plaza Santa Fe, NM 87507.
3.8 If delivery is via freight service (Saia, Estes or Etc.), freight prices are estimates and cannot be guaranteed. Unless otherwise specified on the quote proposal, freight is quoted as dock to dock service. Additional charges may apply.
3.9 If delivery is via mailing service (USPS, Every Door Direct Mail or Etc.), mailing prices are estimates and cannot be guaranteed. Additional charges may apply. Method of mailing is up to the discretion of the customer (type/class). Customer is also responsible for mailing list scrubbing, deduping and/or verifying. See “mailing terms” for additional mailing terms.
Retail & Commercial Customers- Claims:
4. All product that leaves the New Mexican Inc. facility passes extensive quality control tests. Any damage, loss of package or misuse that occurs after the product leaves 1 New Mexican Plaza, Santa Fe NM 87507 facility with a third party, the New Mexican is not liable.
4.1 All claims for defective or damages goods or for shortages must be made in writing within 3 calendar days after the receipt of goods. Failure to do so shall constitute irrevocable acceptance of the goods and a waiver of any defect, damage or shortage. The New Mexican Inc’s liability shall be limited to the quoted price per copy of any defective goods, and in no event include special or consequential charges.
4.2 Claims of invoice discrepancies must be made in writing within 30 calendar days of invoice date.
4.3 Prepress & Graphic Design Services: Services and proofs are as specified and included in the prices. Pricing is based on “Print-Ready” files, no manipulation necessary. Should files require additional work, the New Mexican Inc., will do the work with a fee of up to $300 with notice to the customer.
4.4 Accuracy of Specifications: For commercial print customers, price quoted is based on the accuracy of the specifications provided. The New Mexican Inc. may re-quote a job at the time of submission if files do not conform to the information on which the original quote was based.
4.5 Electronic Files: It is the retail and commercial customer’s responsibility to maintain a copy of the original file.
4.6. For both commercial and retail customers: Color Proofing: Due to differences in equipment, paper, inks, monitors, etc., a reasonable variation in color between color proofs and the completed job is to be expected. When a variation of this kind occurs, it will be considered acceptable performance. Please see “Design Terms & Conditions” for more.
For commercial print customers (5.1-6.1):
Overruns/Underruns:
5.1 Overruns or under-runs will not exceed 3 % (percent) of the quantity ordered. If customer requires a guaranteed quantity, the percentage of tolerance must be stated at the time of quotation.
Storage:
6.1 The New Mexican Inc. will retain intermediate materials used until the related end product has been accepted by the customer. If requested by the Customer, intermediate materials will be stored for an additional period at an additional charge. The New Mexican Inc. is not liable for any loss or damage to stored material beyond what is recoverable by the New Mexican Inc.’s fire and extended insurance coverage. If requested by the customer, completed materials will be stored for an additional period at an additional charge.
For all customers of the New Mexican Inc.(7.1-16.1):
Materials for Limited Use
7.1. This Site contains various content, including graphics, images, text, logos, videos, and other media (“Content”). This Content is the intellectual property of New Mexican Inc. or licensed from third parties, and all rights to the Content are reserved globally.
7.2 You are prohibited from selling, licensing, renting, modifying, copying, distributing, or using any Content except as expressly permitted by these New Mexican Inc. Terms.
7.3 New Mexican Inc. reserves the right to alter, add, or remove any part of the Content without prior notice. Any changes to the Content, whether by you or New Mexican Inc., remain the property of New Mexican Inc. or its licensors.
7.4 New Mexican Inc. does not guarantee that any design you create or upload will not infringe on the trademarks or rights of others. It is your responsibility to seek legal advice regarding the availability of your design for use and ensure that it does not violate others’ rights.
Use of Our Site and Content
8.1 You are granted permission to use this Site and its Content solely for the purpose of preparing, evaluating, and ordering products or services from New Mexican Inc. No other use of the Content is permitted unless explicitly allowed by law or New Mexican Inc. Terms.
8.2 You agree to use this Site in a responsible manner, complying with all local laws and regulations, including export/import laws.
8.3 You confirm that you comply with all relevant sanctions, trade laws, and regulations, and that you are not under any sanctions or associated with parties that are.
8.4 You further confirm that you will not transfer products to certain regions or entities prohibited under applicable trade laws.
Restrictions on Use
9.1 Without limitation, you may not use our Content for the following purposes:
- Sub-licensing, selling, renting, or transferring any rights granted to you
- Claiming exclusive rights to any Content
- For unlawful or discriminatory purposes
- For offensive, harmful, or abusive content
- Creating misleading or deceptive designs
- Violating intellectual property rights or privacy laws
- Using the Content for any purposes that imply endorsement of specific movements or causes
- Any other use that violates applicable laws or regulations.
9.2. By placing an order, you confirm that you have all necessary permissions and rights to use the content and that you authorize New Mexican Inc. to produce and modify it for your order and marketing purposes.
Delivery, Title, and Risk
10.1 New Mexican Inc. will deliver products to the address specified in your order confirmation or quote form, provided full payment has been received (unless other terms have been met in a signed commercial quote). Delivery times are estimates. We may deliver products in installments, and each installment will be treated as a separate agreement. Delays or defects in one installment do not cancel the entire agreement.
10.2 The risk of loss and title of printed products pass to you upon delivery to the carrier. All product that leaves the New Mexican Inc. facility passes extensive quality control tests. Any damage, loss of package or misuse that occurs after the product leaves 1 New Mexican Plaza, Santa Fe NM 87507 facility with a third party, the New Mexican is not liable.
10.5 For electronic products, delivery is considered complete once the product is emailed or made available for download. The customer is responsible for inspecting products upon delivery and reporting defects or damages within 3 days. Failure to notify us within this period voids any claim.
Indemnification
11.1 You agree to indemnify New Mexican Inc. and its licensors against any claims, damages, or legal costs arising from your breach of these Terms, the use of content you provide, or third-party services.
Disclaimer of Warranty
12.1. The Site and its Content are provided “as is,” with no warranty of any kind, either express or implied. New Mexican Inc. makes no guarantee about the accuracy or reliability of the product descriptions on the Site.
12.2. Some jurisdictions may provide consumer guarantees that cannot be excluded. In such cases, New Mexican Inc.’s liability is limited to the maximum extent permitted by law, either by replacing goods or providing equivalent services.
12.3. We are not responsible for any errors made by the customer, such as design mistakes, poor-quality images, or incorrect order selections. Once the proof has been approved for retail customers,
12.4. New Mexican Inc. has no obligations regarding warranties if defects arise due to misuse or improper handling.
Limitation of Liability
13.1 New Mexican INK disclaims all liability for any loss, injury, cost, or damage incurred by you or any third party. We are not liable for consequential, special, indirect, or incidental damages (including, but not limited to, damages for lost business profits, business interruptions, or data loss) arising from the use of the designs and or product, or any related information, and from any delays or inability to use the New Mexican Inc. site or related information. This applies even if New Mexican Inc. has been informed of the possibility of such damages.
If your jurisdiction does not allow certain exclusions or limitations, these will be limited to the extent permitted by law.
New Mexican Inc. is not liable for improper application or installation of products. New Mexican Inc. is not liable for damage to product or environment that the product is being installed in or at due to improper installation.
Site Feedback
14.1 Any feedback provided to New Mexican Inc. will be considered non-confidential and will become the exclusive property of New Mexican Inc., which can use it freely.
Privacy and Cookies
15.1 Our Privacy and Cookie Policy details how we handle your information. This policy applies to your use of the Site, services, and transactions conducted through the Site.
Miscellaneous
16.1 To use this Site, you must be at least 18 years old or have parental consent. If any provision of these Terms is found unenforceable, it will be modified or removed, and the remaining provisions will continue to be valid.
Product Terms & Conditions

These Product Terms and Conditions (“Product Terms”) warn against improper use and correct care of the Products. The New Mexican Inc.’s (“New Mexican Inc,” “we,” “us,” or “our”) General Customer Terms and Conditions along with any capitalized terms, are included by reference and form part of these Product Terms. In case of any conflict between the General Terms of Use and the Product Terms, the Product Terms will take precedence.
By purchasing our Products, you agree to be bound by both our General Terms and Services and, more specifically, by these Product Terms. Please read both the Product Terms and our General Terms & Services carefully. Warnings
Magnets:
Failure to observe these warnings could damage the Magnet or your vehicle and increase the risk of the Magnet not adhering properly and falling off.
- Do not use a Magnet if it has bubbles, wrinkles, bent corners, edges, or any other damage.
- Never exceed speed limits or any recommended maximum speeds when using the Magnet.
- Avoid placing the Magnet over protruding parts or concave areas, such as moulding, lights, reflectors, decals, pin stripes, air intakes, wells, or spoilers.
- Do not apply the Magnet to horizontal metal surfaces, such as car roofs, or expose it to direct sunlight or extreme heat.
- Do not stack one Magnet on top of another on vehicles.
- Long-term outdoor use of the Magnet on painted surfaces may lead to fading, as it shields the paint from ultraviolet rays.
- The Magnet is not intended for use underwater or on aircraft.
- Always remove the Magnet before taking your vehicle through a car wash.
- Long-term magnet use will result in uneven paint coloring from fade naturally caused by sun exposure.
Acrylic Products:
- Do NOT use alcohol or alcohol based products to clean. This will result in cracks in the product.
Signage
- Avoid using harsh chemicals when cleaning.
Paper Products
- Avoid extreme heat or humidity when storing paper products. Can cause damage to paper if not stored correctly.
Photo Paper Products
- Only touch the edge of the product when handling to avoid smudges and oil transfer from hands.

Mailing Terms & Conditions

These Mailing Terms of Use (“Terms”) outline the conditions under which SFNM INK (“New Mexican Inc,” “we,” “us,” or “our”) will execute your Mailing project. The New Mexican Inc. General Terms & Conditions & available at www.sfnmink.com/terms-conditions , are incorporated by reference into these Terms, except where explicitly modified below.
By requesting a Mailing project from New Mexican Inc., you agree to adhere to these Terms. Please review them, including the New Mexican Inc. General Terms of Use incorporated herein, thoroughly. If you do not agree to these Terms, New Mexican Inc. will be unable to complete your Mailing project.
USPS Delivery Disclaimer: Our services include design, printing, and mailing preparation. However, we do not handle mail delivery, which is managed by the United States Postal Service (“USPS”). We are not affiliated with USPS and cannot guarantee delivery dates or schedules. All delivery dates are approximate, not guaranteed. New Mexican Inc.’s responsibilities are limited to printing, preparing your mailing, and delivering it to USPS. New Mexican Inc. is not liable for any USPS-related delays, damages or failures in delivery.
New Mexican Inc. will not be responsible for any third-party services, including other mail delivery providers.
New Mexican Inc. will only be liable for printing or mailing errors to the extent of re-mailing the corrected job as soon as reasonably possible. Jobs will only be re-mailed if damages were done during the printing and packaging process. Any damages for such errors are limited to the cost of the printed work performed.
Postage fees are non-refundable once the mail pieces are processed for mailing. In no event will New Mexican Inc. be held responsible for loss of business, profits, incidental or consequential damages, or any costs beyond the agreed billing for services rendered, regardless of whether the cause is errors, omissions, or failure to perform services.
Mailing method is determined by the customer. Customer must select class or mail type. New Mexican Inc. is not liable for their choice of mail type or class.
Postal regulations may change, and it is your responsibility to comply with current mailing restrictions. We have developed file preparation guidelines and product templates to help you create print-ready files.
New Mexican Inc. is not responsible for scrubbing, deduping or verifying mailing lists.
New Mexican Inc. reserves the right, at its sole discretion, to decline any Mailing project or to discontinue a project at any point before its completion, for any reason. You agree that New Mexican Inc. will not be liable to you or any third party for any consequences arising from such a decision.
Member Account Terms and Conditions

These Member Terms and Conditions (“Terms”, “Agreement”) govern the use of your online account (“Account”) and the services provided by New Mexican Inc. (“we”, “us”, “our”). By registering for and using your Account, you agree to abide by these Terms as well as the General Terms & Conditions and Commercial Customer Terms & Conditions. If you do not agree with these Terms, you must not use or access the Account or our services.
1. Eligibility
You must be at least 18 years or older [or have parent or guardian permission] to create an Account. By creating an Account, you represent and warrant that you are of legal age and have the legal capacity to enter into this Agreement.
2. Account Registration
To create an Account, you will need to provide accurate and up-to-date information, including your full name, email address, password, and any other required details. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.
3. Use of the Account
You agree to use the Account only for lawful purposes and in accordance with these Terms. You must not use the Account for any activities that:

- Infringe any intellectual property rights of others;
- Engage in fraud or misrepresentation;

If you decide to share your Account or login credentials with any third party New Mexican Inc. is not responsible for any actions performed within your account by the aforementioned third party. You are solely responsible for any activities that occur under your Account.

Any content, including but not limited to text, images, logos, designs, and software associated with the services provided through your Account, is owned by or licensed to New Mexican Inc. and is protected by intellectual property laws.

All payments are non-refundable unless otherwise specified in writing by New Mexican Inc.
8. Limitation of Liability
We do not guarantee that the services will be error-free, secure, or uninterrupted. To the fullest extent permitted by law, New Mexican Inc. shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your use or inability to use the Account or our services, including but not limited to loss of data or profits.

You agree to indemnify and hold harmless New Mexican INK, its affiliates, and its employees from any claims, damages, losses, or expenses arising from your use of the Account or your violation of these Terms.

Any changes will be effective immediately upon posting to our website or through notification via email or within the Account. By continuing to use your Account after such modifications, you agree to the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state of New Mexico, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the state of New Mexico.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Design Terms and Services
By using this site you agree to the Design Terms & Services as well as New Mexican Inc (“New Mexican Inc,” “we,” “us,” or “our”) General Customer Terms & Conditions, Member Account Terms & Conditions and Product Terms & Conditions if applicable.
Designs
By uploading, emailing, linking (directly or indirectly), or otherwise providing New Mexican Inc. with any text, images, designs, or other content for inclusion in your Design Services project, you guarantee and affirm that you possess all necessary rights and authority to use such content. Furthermore, you assure that the provision of Design Services by New Mexican Inc. will not infringe on any trademark, copyright, or other intellectual property rights of any third party.
If graphic design is being provided by New Mexican Inc. customer is limited to a maximum of 2 revisions after the initial design is sent (unless otherwise noted in commercial job contract). If deadline for product is missed due to customer not approving designs within agreed time window, New Mexican Inc. is not liable and customer is still fully responsible for product purchase.
Requirements:
New Mexican Inc. retains the right, at its sole discretion, to reject any Design Services project or terminate any project before its completion at any time and for any reason. You agree that New Mexican Inc. will not be held liable to you or any third party for any consequences resulting from such refusal or termination.
New Mexican Inc. also reserves the right to use any Designs and/or the completed Design Services project products as samples for promotional and advertising purposes, as well as for internal use.
Projects will be canceled by New Mexican Inc. if there is no response to the proof approval within 10 days of it being sent to the customer before printing. Once you approve the proof, it will be considered as your acceptance of the Designs, and all amounts paid or owed for the Design Services project are non-refundable.
You are responsible for providing any images or other content necessary to complete the project. You must notify New Mexican Inc. of any requested changes, updates, or enhancements to the project starting from the date of sale. If you would like New Mexican Inc. to create content for you, please reach out at the start of the project via our commercial printing services.
For any requests to cancel services, you must contact New Mexican Inc.’s Customer Care team at inquiry@sfnewmexican.com.
Damages and Liabilities
New Mexican Inc disclaims all liability for any loss, injury, cost, or damage incurred by you or any third party. We are not liable for consequential, special, indirect, or incidental damages (including, but not limited to, damages for lost business profits, business interruptions, or data loss) arising from the use of the designs and or product, or any related information, and from any delays or inability to use the New Mexican Inc. site or related information. This applies even if New Mexican Inc. has been informed of the possibility of such damages.
New Mexican INK does not warrant that any Design will not infringe on or be subject to claims of infringing any trademark rights, copyrights, or any other intellectual property rights of third parties. It is solely your responsibility to seek legal counsel to ensure that the Design is legally available for your use and does not infringe on the rights of others.
All delivery times are approximate, and New Mexican INK is not liable for any delays in design services projects or any impacts to your business caused by late delivery or printing.
